Rainbow Mountain Treks (P) Ltd. – Kathmandu, Nepal
These Terms & Conditions form a binding agreement between you (“the Client”) and Rainbow Mountain Treks (P) Ltd. (“RM Treks”), governing all trekking, tour, and expedition services provided. By booking with RM Treks, you agree to comply with the following terms.
1. Booking and Payment
- Deposit: A non-refundable deposit of 25% of the total trip cost is required to secure your booking.
- Final Payment: The remaining balance must be paid at least 30 days prior to the trip departure date. For custom or international trips (e.g., Bhutan/Tibet), full payment is due 60 days in advance.
- Late Booking: If booking is made within 30 days of departure, full payment is required at the time of booking.
2. Cancellation & Refund Policy
By the Client:
- More than 30 days before departure: Refund minus deposit.
- 15–30 days before departure: 50% of total cost refunded.
- Less than 15 days before departure: No refund.
By RM Treks:
RM Treks reserves the right to cancel any trip due to:
- Political unrest, natural disasters, pandemic-related restrictions, or other force majeure events.
- Insufficient participant numbers.
In such cases, RM Treks will offer:
- Trip rescheduling or credit transfer, at the client’s choice.
Note: RM Treks is not liable for costs incurred outside the trip package (e.g., flights, insurance, visas).
3. Trip Amendments
- Itinerary changes may occur due to weather, health, political, or safety concerns.
- Minor route changes that do not significantly affect the trip will not result in compensation.
- Clients requesting date changes within 30 days of departure may incur additional administrative charges.
4. Insurance Requirements
Travel insurance is mandatory for all participants and must include:
- Emergency evacuation
- Medical treatment
- Trip cancellation and interruption
- Baggage loss/theft
Clients must provide proof of insurance before departure.
5. Travel Documents & Health
- Clients must hold a valid passport and obtain any required visas prior to the trip.
- RM Treks recommends a health check before participating in any high-altitude trek.
- Clients must disclose pre-existing medical conditions that may affect their participation.
6. Assumption of Risk
RM Treks' itineraries include trekking in remote, high-altitude environments. By booking, you acknowledge:
- Risks associated with altitude sickness, unpredictable terrain, weather, and remoteness.
- Your physical fitness and ability to complete the chosen itinerary.
- That RM Treks, while maintaining high safety standards, is not liable for injuries, accidents, or personal loss beyond its control.
7. Responsibility & Liability
- RM Treks acts as an agent for transport, lodging, and other service providers and is not liable for their acts or omissions.
- RM Treks is not liable for events beyond its control, including but not limited to delays, strikes, flight cancellations, political unrest, pandemics, or acts of God.
8. Code of Conduct
- Respect local cultures, customs, and guides.
- Follow safety instructions and group decisions, particularly in challenging environments.
- RM Treks reserves the right to remove any participant who jeopardizes group safety or disrupts the experience.
9. Photo Release
RM Treks may use photos or videos taken during the trip for promotional purposes unless you specifically request otherwise in writing before departure.
10. Governing Law & Dispute Resolution
These Terms & Conditions are governed by the laws of Nepal. Disputes arising from this contract shall be settled under the jurisdiction of the courts of Kathmandu.
